In Germany , There Are Several Legal Decisions That Allow the Sale of ESD OEM Keys.
The Decision of the BGH allowed the sale of OEM Versions and DSP versions Without associated Hardware (BGH , Judgment of 6 July 2000,I ZR 244/97) . According to ECJ Judgment of 3 July 2012 , the sale of software is also permitted without data carriers.
The Frankfurt district court decided on 18.06.2014 (AZ 2-06 O 469/13) that the sale of the serial number (ie the activation key) without a Certificate of authenticity (ie COA) is permissible , where it says on page 15 : the serial Number itself is legally neutral and can be passed on without COA.
